Service: An act of helpful activity; help; aid: to do someone a service.

Terms: Conditions or stipulations limiting what is proposed to be granted or done.

Now that it is understood what is presented on these pages enjoy the fun reading of how HomeFree expects our users and Sponsors to interact with each other, and with us!

The service of HomeFree is to provide buyers and sellers of property of any type an avenue to find each other and come to an accord whereby neither party needs to participate in paying traditional Real Estate Transaction Fees. This act will be referred to as the Services offered by HomeFree.

Any access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. Simply accessing or using the Services you agree to be bound by these Terms.

Basic Terms:

You the user are solely responsible for your use of the services offered at HomeFree, any content you submit or "post" on HomeFree and are responsible for any consequences thereof. The Content you submit, post or display will be potentially viewed by other users around the world, as well as third party services that YOU the user chose to interact with while using the Service provided by HomeFree.

Forming a binding contract with HomeFree is the only recognized method for using our Service, provided you are not barred from receiving our service under the laws of the United States or any other applicable jurisdiction. Using our service is only allowed while following the Terms set forth in this document, while adhering to all local, state, national, and international laws, rules and of course the ubiquitous lawyer speak known as regulations.

HomeFree's services are always evolving, wherein the nature of how HomeFree provides the service rendered may be altered without prior notice to you. HomeFree reserves the right to cease Services either temporarily or permanently to you and or other users including all users without the possibility of prior notice. HomeFree retains the right to limit use and storage at our sole discretion at any time without prior notice to you. Services will include advertising, which is specifically targeted to the user based on user input and our proprietary System of Real Estate Acquisition. Content authorized by you to be sent to Sponsor sites is hereby authorized by you in order to obtain Sponsor services performed by third party vendors found on HomeFree. Sponsors are subject to change without notice.

Privacy: Freedom from unauthorized intrusion : the state of being let alone.

Information that you freely give to HomeFree is subject to the current Privacy Policy. This is the policy that governs all collection and use of your data. Using our Service by agreeing to the Terms of Service you consent to HomeFree's use of your data in order to facilitate the very process by which we are in existence. Inherently this includes the transfer of information primarily in the United States, however considering that our service is specifically focused on the World Wide Web, our lawyers insisted that we include that your information may indeed travel all the way around the world. Due to potential updates in service or modification in expected service HomeFree reserves the right to allow for service announcements as well as administrative messages. Understand that while using HomeFree and the Services found herein you may not be able to opt out of the aforementioned announcements or service agreements. (Please note that these will primarily indicate a need to update your listing as a seller in order to maintain an up to date database of available properties for sale…..it is not the spirit of this caveat to inundate our beloved users with spam email, this neither serves our purpose of existence nor does it endear us to our users, please note that we are well aware of that!)

Password: A word or string of characters, sometimes kept secret or confidential that must be supplied by a user in order to gain full or partial access to a multi-user computer system or its data resources.

Intelligent Password selection using letters both lower and upper case as well as numbers presents a strong password. (Symbols help as well; think of it as a fun game of who can make the strangest password!) HomeFree will NOT be liable for any loss or damage arising from your failure to create a well-protected password. You are the individual creating it. Always bear this in mind.

Content of Services and Sponsors:

(You've made it this far defining Content et. al seems redundant no?) You create the content transmitted and received as a user of HomeFree. This content may be public or privately transmitted. HomeFree does not take responsibility for any content. HomeFree does not translate an inherent trust with any Sponsor found on the site. It is the sole responsibility of the user to choose, which Sponsor shall be used if any during each step of our Service Process Model. All Sponsor services obtained by you the user is done so at your own risk, HomeFree shall not be held liable in any way anywhere in the world. Further there is a possibility that as a user there may be inappropriate material found on HomeFree, obviously this is not our intent, however the possibility may arise and therefore be advised that this is a user generated Service. HomeFree will diligently attempt to remove ANY and all offensive material at our discretion. Bear in mind that HomeFree is well aware that this should be an extremely family friendly environment, as the founders we hope to use our own service with our children as well without worry of offensive images and language presented.

Your Rights:

Rights – Adherence or obedience to moral and legal principles and authority.

Your content is yours and you retain the "Rights" (legal terms are fun aren't they) to all content you post or display in the course of using our Service. You agree that submitting or posting, and finally displaying any Content during the course of our Service you are granting HomeFree worldwide, non-exclusive, royalty free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute stated Content in any and all media or distribution methods currently known or developed in the future. By agreeing to the Terms of Service you are authorizing HomeFree to allow your listings and communication resulting from our Service to the rest of the World. With that clearly stated, what is yours, remains yours. Further you agree that HomeFree retains the right to license the content in order to make referred to content available to third party Sponsors, organizations, or individuals found as a result of the Service offered by HomeFree. Such content may be used for broadcast, syndication, distribution and other media, which may not be in existence at this time.

HomeFree or other companies, organizations or individuals who partner with HomeFree may allow for additional uses of the aforementioned content information provided by the user.

HomeFree Rights:

All right, title, and interest in and to the Services provided by HomeFree with exception to the information provided by our users remain the property of HomeFree. All applicable laws protect the Services provided by HomeFree, including but not limited to Copyright, Trademark and any other applicable laws found in the United States as well as foreign countries. HomeFree has never implied in the reading of these Terms of Service that the user may use borrow copy infringe or otherwise defame the HomeFree logos, trademarks, domain names, or any other distinctive brand aspects of HomeFree. We appreciate any feedback that you may offer in regard to the Terms of Service and indeed request for your perspective. Feel free to offer words of criticism or encouragement via info@homefree.com. Should you determine that a portion of our Process model is lacking by sending your suggestion in no way does that entitle you to royalties or payment of any kind. Understand that we have no obligation monetarily to you for your suggestion, but please do note that it is warmly received.

Restrictions on Content and Use of Services:

Restrictions: a limitation on the use or enjoyment of Property, Facility or Service.

Understand that as stated in the Content on Services portion of the Terms of Service we addressed the following: We have no obligation but yet reserve the right to remove or disallow any information provided to HomeFree by the user which may be deemed offensive or inappropriate with regard to the goal of HomeFree to remain indeed Free for users to use as well as family appropriate. HomeFree reserves the right to disclose any information sought with regard to the following: To protect the property of HomeFree our users and the public. To address fraud, technical or security issues or concerns. To enforce our own terms which to reiterate you the user agree to by agreeing to these terms. Finally to satisfy any applicable law, regulation, legal process or governmental request, please review our Privacy Policy.

You may not do the following items to HomeFree or any third party entity found herein:

• Access and or tamper non-public areas of HomeFree, our computer systems or any delivery mechanism.
• Probe or scan any system or network or circumvent, and finally breach security or authentication measures.
• Access or search the information contained on HomeFree or any subsidy, entity except by those, which are currently authorized by HomeFree.

Please bear in mind that crawling services is permissible while done in accordance with the provisions of robots.txt file. Make SPECIAL NOTE: scraping HomeFree without prior consent is expressly prohibited and will be pursed to the fullest extent of allowable law.

• Forge information in any email or fraudulent listing. Either action while using HomeFree will result in prosecution to the fullest extent of the law wherever applicable laws may be participated herein.
• Disrupt or interfere with a user or number of users of HomeFree. This obviously includes attempting to send a virus, overloading, flooding, spamming, mail-bombing etc. al. scripting the creation of Content in such a manner as to interfere with or create an undue burden on HomeFree.

Copyright Policy:

Our website depends on scripting languages such as JavaScript to create an efficient and useable interface. If you browse the internet with scripting disabled, you will have to turn scripting on when you visit our site. However, scripting can turn on automatically for our site if you take advantage of your browser's Trusted Sites feature. Add the Homefree.com domain name to your Trusted Sites Security Zone in your browser and scripting will remain disabled for most of your internet browsing, but will come on automatically for HomeFree.com.

Copyright – The exclusive right to make copies, license or otherwise exploit a literary, musical, or artistic work, whether printed audio or video etc.: Works granted by law on or after January, 1978, are protected for the lifetime of the author or creator and protected for a period of 50 years after his or her death.

Policy – a definite course or method of action selected from among alternatives and in light of given conditions to guide and determine present and future decisions; a high-level overall plan embracing the general goals and acceptable procedure.

HomeFree is different than other companies, some talk about CLARITY in business we actually define our stance while providing our Terms of Service, hence the definitions of terms included. HomeFree will address alleged copyright infringement. We expect our users to respect commonly understood Copyright terms as mentioned above. In order to facilitate any possible infringement please provide the following in a possible complaint.

A.   Physical or Electronic Signature of the copyright owner or authorized personal acting as their counsel.

B.   Identifiable evidence of the potential copyright.

C.   Identified material that which is claimed to be infringed along with contact information in order to procure validity of statement of facts. (This should include address, phone, email, so we can address the potential infringement in an expedient manner.)

D.   A clear statement by the copyright holder or counsel representing holder that use of material mentioned in complaint B is not authorized by the owner of the copyright, its agent or the law.

E.   Statement that notification is accurate under penalty of perjury.

Services Available "As is"

You understand that you access and use the Service of HomeFree and any content provided by you and received by you at your own risk. You understand and agree that the Services provided are "As is" and when Available. Understand that we are not beholden to you the customer to maintain HomeFree's Services and we may cease to offer services at our discretion. However we also understand that this would not endear our value system to our customers and therefore it is our desire to maintain our Services at all times. HomeFree does not provide a warranty of any kind to any participant in the Services offered to users of HomeFree. We are not liable, and hold nor responsible for completeness or accuracy or availability of user provided content. HomeFree is not responsible for any harm or damage done to your computer system, loss of information or any other harm that may result from using HomeFree's Service. HomeFree is not held responsible to transmit user supplied information in any form; we chose to do so at our discretion. Statistics provided during the Service Process is not deemed advice, simply statistical analysis of a given situation. Please note that statistics to not represent a guarantee.

We understand that we are an advertising entity providing a service for free to our users. It is the discretion of the users that will result in a positive experience throughout the Service Process provided by HomeFree. We do not endorse, or support any Sponsor with greater or lesser degree than any other. Position of Sponsorship is based on a bidding process found in similar advertising services throughout the Internet.

Limitation of Liability:

Limitation – restrictive weakness; lack of capacity; restriction or a boundary.

TO THE MAXIMUM EXTENT PERMITTEDD BY APPLICABLE LAW, HOMEFREE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM

A.   YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

B.   ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, CINCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES.

C.   ANY CONTENT OBTAINED FROM THE SERVICES.

D.   UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT HOMEFREE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

1.   HOMEFREE.COM INC DOES NOT IN ANY WAY CHARGE YOU THE CUSTOMER FOR OUR SERVICE. IT IS FREE.

2.   HOMEFREE.COM INC DOES NOT IN ANY WAY ENSURE THAT YOUR PROPERTY WILL BE BOUGHT OR SOLD.

3.   HOMEFREE.COM INC HAS NO VESTED INTEREST IF YOUR PROPERTY SELLS FOR US $1.00 OR THE ENTIRE GROSS DOMESTIC PRODUCT OF THE UNITED STATES. UNDERSTAND HOMEFREE.COM INC HAS NO VESTED INTEREST IN THE PRICE YOU BUY OR SELL THE PROPERTY.

4.   HOMEFREE.COM INC WILL NOT BE HELD LIABLE FOR ANY REASON SHOULD YOUR HOME BUYING OR SELLING PROCESS BECOME INTEREPUTED BY EITHER PARTY(IES). AGAIN CLEARLY UNDERSTAND HOMEFREE.COM INC IS MERELY A MESSAGE BOARD WITH A GUIDED PROCESS TO OFFER A FREE SERVICE TO BUY OR SELL PROPERTIES.

5.   HOMEFREE.COM INC WILL NOT BE RESPONSIBLE IN ANY WAY FOR YOUR TRANSACTION, WE ARE SIMPLY A MESSAGE BOARD WITH A GUIDELINE. SHOULD YOU FEEL THE NEED TO ADHERE TO YOUR OWN CONCEPT OF BUYING OR SELLING YOUR PROPERTY, BY ALL MEANS KNOW THE FOLLOWING:

Exclusions:

Exclusions – (Ironically Dictionary.com uses this definition.) – the state of being excluded.

Where jurisdictions do not allow for exclusionary warranties the limitation of liability may not apply. We reserve the right to refuse service to these jurisdictions. Waiver and Severability:

Should we fail at HomeFree to enforce any right or presumed provision spoken of within these Terms, HomeFree will not accept this as a waiver of such a right or provision. If any portion or provision of these Terms is found to be outside the validity of enforceable laws, this does not limit the remaining portions of Terms, which will remain in full-enumerated force.

Controlling Law and or Jurisdiction:

Controlling – to exercise restraining or directing influence over : regulate.

Severability – a binding custom or practice of a community, a rule of conduct or action prescribed or formally recognized as binding or enforced by controlling authority.

Jurisdiction – the power, right, or authority to interpret and apply the law.

These Terms as well as the business entity itself is founded in California. Therefore it is the California law that will remain without regard to a conflict of law or provision in your area of dwelling. All claims will be brought to bear solely in Orange County California, by agreeing to the Terms of Use you understand that you consent to the jurisdiction of and venue to be in California courts and waive any objection with regard to any incontinence you may endure as a result. For some reason it must be addressed that should you be accepting the above Terms on behalf of a United States Federal Entity which is legally unable to accept the controlling law, jurisdiction or venue clauses mentioned above, then those clauses do not apply to you, but rather these Terms and any action related thereto will be governed by the laws of the United States of America without reference to conflict laws and, in the absence of federal law and to the extend permitted under federal law, the laws of the State of California excluding choice law).

Entire Agreement:

Entire – having no element or part left out.

Agreement – harmony of opinion, action, or character; an agreement as to a course of action; a contract duly executed and legally binding.

HomeFree’s Terms, Rules, and Privacy Policy are the entire and exclusive agreement between HomeFree and the user…you. We may revise these Terms from time to time, which while mind numbing can prove necessary. Should we determine a revision is necessary it is our discretion to inform you of new Terms.
